1.2. Documents Required From The Foreigner In The First Application

2. Extension Application

The request for extension of the work permit is made directly to the Ministry of Labor and Social Security by the foreigner or the employer, by adding the original of the previous work permit to the documents specified in the application form and the application regulation.

* Foreign Direct Investments with Special Features

Within the scope of the “Regulation on the Employment of Foreign Personnel in Foreign Direct Investments”, work permits are subject to special provisions and it is aimed to give work permits more easily. Work permit applications for personnel to be employed in foreign direct investments outside this scope are subject to the above-mentioned general provisions (Law No. 4817 and Implementing Regulation).

Two basic conditions determine the scope of the Regulation on the Employment of Foreign Nationals in Foreign Direct Investments:

  • Special Foreign Direct Investments (including liaison offices)
  • Foreign national key personnel

  • Foreign direct investment in at least one country other than the home country of the parent company

Key staff; The board of a company having legal personality in Turkey and is the staff providing at least one of the following conditions:

a)  Taking part in at least one of the following areas or having authority on these issues; company partner, chairman of the board, board member, general manager, assistant general manager, company manager, deputy director and similar person

  • Working in the company’s senior management or executive position
  • Managing all or part of the company
  • Supervising or controlling the work of the company’s auditors, administrative or technical personnel

c)  At most one person, whose authorization certificate is issued by the parent company abroad in the liaison offices

Fee on Work Permit for Foreigners: In accordance with the Law No. 492 on Work Permits, work permit documents to be given to foreigners are subject to charge. If the work permit request is deemed appropriate by the Ministry of Family, Labor and Social Services , a fee should be paid according to the permit period to be granted.
